More And More Supermarkets Are Banning Dogs From Coming Inside

Publix, the renowned chain of Florida supermarkets celebrated for its fresh produce, buy-one-get-one deals, and signature sandwiches known as Pub Subs, has caught the attention of its customers with the introduction of prominent signs at the entrances of its stores across Florida. These signs serve as a reminder to shoppers that only service animals are permitted within the store premises, explicitly excluding personal pets and even emotional support animals.

The distinction between service animals and emotional support animals is elucidated on the sign itself: “Under federal law, service animals are dogs or miniature horses trained to perform tasks for people with disabilities,” it states. The message continues, emphasizing that animals whose primary function is to provide comfort, companionship, or emotional support are not classified as service animals. Consequently, they do not meet the criteria for entry into Publix stores, regardless of having a doctor’s note.

Although the company’s policy on service animals has been in place for a considerable time, the introduction of these new signs has raised questions about the motive behind the initiative. Publix has not provided an official statement regarding this update. Notably, a spokesperson for the company’s South Florida region has not yet responded to requests for comment.

A regular customer of the Southern Boulevard Publix, identified only as Jeff, shared his perspective on the matter. Jeff, who relies on a service dog to cope with both an ongoing battle against cancer and experiences from his military past, views the store policy as a practical safety measure. He expressed concerns about the potential presence of aggressive dogs within the store, highlighting the risk of them causing harm to fellow shoppers.

Another shopper, Mark, lauded the new signs for drawing a clear boundary between animals and grocery stores. He emphasized the potential hygiene issues that could arise when pets are brought into the store, especially when placed inside shopping carts. The sentiment seems to align with Publix’s policy, which explicitly prohibits animals, including service dogs, from being carried in shopping carts or wheelchair basket attachments.

The policy maintains that all animals can be removed if they pose a threat to others, are unruly, or not housebroken. Publix offers an alternative solution for individuals with animals that fall into these categories, providing personal shopping assistance upon request. Additionally, the signs reiterate that Florida law strictly prohibits the misrepresentation of pets as service animals. The offense is considered a second-degree misdemeanor and is penalized by 30 hours of community service for an organization assisting individuals with disabilities.

While many customers seem to support Publix’s stance on animals in their stores, enforcing these rules can be a challenge. Josephine Grace, the owner of Dog Training Elite in Palm Beach County, shed light on the complexities. Grace highlighted that some dogs, though well-behaved and under control, may not be officially recognized as service animals. Distinguishing between service dogs, which undergo specific training to perform tasks for their owners, and other dogs can be difficult.

State law does not mandate documentation proving a service animal’s training, and staff members are prohibited from inquiring about the nature or extent of an individual’s disability. However, public accommodations are allowed to ask whether an animal is a service animal required due to a disability and what tasks it has been trained to perform.

As Publix takes a firm stance on animal entry in its stores, the move raises broader discussions about accommodating individuals with disabilities while also maintaining a safe and sanitary shopping environment for all customers.
