According to the New York Post, Judge I’Ashea Myles ruled on October 8 that Christa Pike could revive her challenge to Tennessee’s lethal injection protocol. The decision followed a September 30 execution attempt that her attorneys say she survived after receiving pentobarbital. They described difficulties accessing her veins and serious medical complications afterward. Myles found extraordinary circumstances justified reopening the case, allowing renewed consideration of whether the procedure is unconstitutional as applied to Pike.

The ruling does not overturn Pike’s death sentence for the 1995 murder of her 19-year-old Job Corps classmate, Colleen Slemmer. Nor does it guarantee protection from another execution attempt. Her lawyers maintain that her medical circumstances make the state’s method particularly dangerous. Tennessee officials reportedly paused remaining executions pending an independent review, and no new execution date has been confirmed. For now, the legal challenge resumes, with questions about the procedure—and the state’s next steps—still unresolvedRead more below.
